conveyancing quotes

23 Jun 2011

Conveyancing Quotes that you receive from your solicitor should consist of two parts to include information on the conveyancing solicitor’s basic fee and the disbursements that you can expect in a conveyancing transaction.

The Conveyancing Solicitor’s Basic Fee

This is the basic cost of the solicitor’s time in processing your transaction. This can vary a lot between firms (a spread of £500 is not unusual).

This is because when providing conveyancing quotes UK conveyancing solicitors will charge their clients in 1 of 3 ways:

  1. On a “fixed-fee” basis.
  2. On a scale that links their fee to the value of the property or type of property e.g. Freehold or Leasehold, you’re buying or selling.
  3. On a “per hour” basis (reasonably common).

Disbursements

Disbursements are things a conveyancer has to pay other people for, on your behalf. This information should also be included in conveyancing quotes.

Really they should be roughly the same from one conveyancing quote to the next. They are after all, fixed charges and I’ll list them all (along with what they should cost) a little later on.

The disbursements vary depending on whether you are buying or selling property.

A Commercial property lawyer will specialise in property law, however it is different to residential property. Commercial conveyancing is the process by which interests in commercial property are created and transferred and you need to instruct a commercial property lawyer to assist you with this opposed to a regular conveyancing lawyer who will usually deal with residential properties.

Many issues affecting commercial conveyancing also affect residential conveyancing, although commercial property lawyer will deal with many more complex matters during the transaction. It is not to day that a commercial property lawyer will not also carry out residential conveyancing and vice versa – although you should check this with your chosen firm.

A conveyancing lawyer is a solicitor or lawyer who practices solely or mainly in the area of conveyancing or property law.

A conveyancing lawyer will be able to assist you in your conveyancing matter, regardless of whether you are carrying out a sale, purchase, remortgaged, transfer of equity or something a little more complex.

If you find yourself needing assistance in any of the above areas, then you are always best to consult a conveyancing lawyer as early on in the process as possible. This will ensure that your matter progresses as quickly and smoothly as you require. They can also advise you on what you need to do depending on which transaction you are embarking on.

A Conveyancing solicitor is a solicitor who specialises in conveyancing.

For those of you who are not familiar with this term, solicitors who deal with the transfer of ownership of property. This is more commonly referred to as a sale or purchase of property.

A conveyancing solicitor will be able to act for the seller or buyer (but not usually both in the same transaction). The tasks that will be carried our by the conveyancing solicitor will differ depending on whether they act for the seller or buyer. However, the principle of the transaction will be the same.

The aim is to transfer the property from one person to another and to ensure that the property is free from encumbrances (legal charges and notices) and has marketable title to ensure that the new owner will be able to resell the property.
